US Files Complaint Against Against Oracle Corporation and Oracle America Inc

The United States has intervened and filed a complaint under the False Claims Act against Oracle Corporation and Oracle America Inc. The government alleges that Oracle defrauded the United States on a General Services Administration (GSA) software contract that was in effect from 1998 to 2006 and involved hundreds of millions of dollars in sales. Under the contract, GSA used Oracle's disclosures about its commercial sales practices to negotiate the minimum discounts for government agencies who bought Oracle software. The contract required Oracle to update GSA when commercial discounts improved and extend the same improved discounts to government customers. The suit contends that Oracle misrepresented its true commercial sales practices, ultimately leading to government customers receiving deals far inferior to that Oracle gave commercial customers. The suit was originally filed on by Paul Frascella, Senior Director of Contract Services at Oracle. The False Claims Act allows private citizens with knowledge of fraud to file whistleblower suits on behalf of the United States and share in any recovery. If the United States intervenes in the action and proves that a defendant has knowingly submitted false claims, it is entitled to recover three times the damage that resulted and a penalty of $5,500 to $11,000 per claim. This case was investigated as part of a National Procurement Fraud Initiative. In October 2006, the Deputy Attorney General announced the formation of a National Procurement Fraud Task Force designed to promote the early detection, identification, prevention and prosecution of procurement fraud associated with the increase in government contracting activity for national security and other government programs. The Procurement Fraud Task Force is chaired by the Assistant Attorney General for the Criminal Division and includes the Civil Division, the U.S. Attorneys' Offices, the FBI, the U.S. Inspectors General community and a number of other federal law enforcement agencies.

Cox Communications Reduces Environmental Impact With Oracle Corp

Cox Communications Inc. has significantly reduced its carbon footprint with the help of Oracle E-Business Suite and Oracle Imaging and Process Management, a component of Oracle Content Management. As a wholly owned subsidiary of Cox Enterprises, Cox Communications wanted to support Cox Conserves, an enterprise-wide initiative designed to strengthen the company's sustainability leadership in the communications industry by reducing its carbon footprint by 20%. To support Cox Conserves, Cox Communications automated the entire procure-to-pay process by leveraging Oracle iProcurement to migrate corporate and cable-system level processes to "one-touch" electronic processes that minimize paper use and increase efficiency across its high volume business. By capitalizing on Oracle's Enterprise Application Documents strategy and the pre- integration between financial applications within the Oracle E-Business Suite and Oracle Imaging and Process Management, Cox Communications was able to migrate to electronic invoices whenever possible, including the establishment of a more robust electronic routing process, reducing company-wide paper-use by three and one-third tons, the equivalent of 19,740 pounds of CO2 emissions, within the first eight months. Additionally, by migrating to electronic processes, Cox Communications has been able to significantly increase efficiencies, reducing the cost of processing vendor invoices by up to 80% when using new processes and the number of account payable transactions by 26%.

Justice Department Sues Oracle Corp. Alleging Contract Fraud

Federal officials have sued Oracle Corp., claiming the company defrauded the federal government on a contract that involved hundreds of millions of dollars in sales. The Justice Department said it filed a legal complaint alleging that Oracle misrepresented its commercial sales practices, causing government customers to receive deals that were inferior to those Oracle gave commercial customers. The software contact was in effect from 1998 to 2006. The Justice Department brought the complaint under the False Claims Act, which provides financial rewards to private litigants who report fraud against the government.
